<br />Mayor and City CouncillP 99-5 <br />May 17, 1999 <br />Page 2 <br /> <br />. <br /> <br />Overview <br /> <br />At the April 19th City Council meeting the Council considered this request. <br />The Council postponed action on this project to allow the applicant an <br />opportunity to address concerns raised by the Council. Those concerns were <br />the removal of trees, the density of the project and the private road. <br /> <br />The applicant has made some revisions to the plan to address the issues <br />raised by the Council. In an attempt to preserve trees the applicant has <br />revised the grading plan, eliminated the berm and removed one townhome. <br />The revised plans show 25 trees being preserved along Meadowvale Road. Of <br />those 25 trees, 9 of them are either within building pad area for the <br />townhomes or close to the proposed trail and are not likely to survive. <br /> <br />. <br /> <br />The project reviewed by the Council on April 19th had 27 townhouses, 3 three- <br />unit buildings and 9 two unit buildings. In response to the issue of density, <br />the revised plan has 26 townhouses, 2 three unit buildings and 10 two unit <br />buildings. The number of townhouses was reduced by one. The question that <br />needs to be resolved is, does the elimination of one unit address the Council's <br />concern regarding density. The reduction of one more 2 unit building in the <br />southwest corner would better address the issue of density and allow for the <br />actual preservation of additional trees. <br /> <br />The proposed street remains a private street. Most townhouse developments <br />have private streets. In Elk River private streets are included as part of the <br />following townhouse developments: <br /> <br />Trott Brook Farms <br />Cottages of Elk River (behind Target on Jackson) <br />Meadowlark Townhomes (on Meadowvale Road by Cretex) <br />Bailey Beck Townhomes (east side of Lake Orono) <br />Barrington Place Townhomes (behind McDonald's) <br />Country Crossing Townhomes <br /> <br />. <br /> <br />With public roads, a 60 foot right-of-way is required and setbacks are <br />measured from the right-of-way. In townhouse developments this means the <br />front of the buildings are about 100 feet apart. Typically in townhouse <br />developments with private streets the front of the buildings are about 60 to <br />70 feet apart. Staff is aware of only one case where the developer of a <br />townhouse project has asked the city to investigate the possibility of <br />assuming maintenance and snow removal responsibilities. This request is <br />likely the result of the homeowners association not being happy with the <br />performance of the maintenance company hired for street maintenance and <br />snow removal, and not a function of street design or operation. <br /> <br />\ \elkriver \sys \shrdoc \planning\scott \p995ccmy .doc <br />
