Box 490 <br />Elk River, Minnesota 55330-0490 <br /> <br />RE: RIVERS CROSSING, INC. <br />EASEMENT VACATION REQUEST <br /> <br />Dear Councilmembers: <br /> <br />We have reviewed the request by Rivers Crossing, Inc. for the vacation of drainage and utility <br />easements in Lots 3 and 4, Block 8, of Brentwood Addition. I have discussed this issue with <br />Gary Santwire. He has indicated that he would like to rework some of the drainage and utility <br />easements to provide a more reasonable building site on Lots 3 and 4 of Block 8, Brentwood <br />Addition. <br /> <br />This addition was platted in approximately 1980. Back in that time frame, the City did not require <br />specific drainage calculations for large rural plats such as Brentwood, but rather looked for <br />sufficient drainage and utility easements to cover the low areas where runoff would naturally <br />flow. As a result, Brentwood Addition has significantly more area under drainage and utility <br />easement than is likely necessary for the runoff from any storm event. Mr. Santwire has <br />indicated his willingness to work with City staff to provide the necessary new easements for <br />drainage purposes. Therefore, we would recommend approval of the request to vacate the <br />drainage and utility easements conditioned up~n Mr. Santwire providing adequate new drainage <br />and utility easements as determined by the City. <br /> <br />If you have any questions regarding this issue,l will be in attendance at your May 17,1999, City <br />Council meeting. <br /> <br />Sincerely, <br /> <br />Howard R.
