<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 99 - <br /> <br />RESOLUTION FOR THE CITY OF ELK RIVER <br />A RESOLUTION FOR VACATING A STREET RIGHT-OF-WAY <br /> <br />Case No. EV 99-2 <br /> <br />WHEREAS, the property owner abutting the street right-ot-way has requested <br />the City Council in a petition dated April 1, 1999, to vacate such <br />right-ot-way according to law; and, <br /> <br />WHEREAS, a public hearing was held on May 17, 1999, betore the City Council <br />at the Elk River City Hall on such petition after due published and <br />~ posted notice had been given as well as personal notice to affected <br />property owners on May 5, 1999, and all persons interested were <br />given an opportunity to be heard; and, <br /> <br />WHEREAS, it appears that it will be in the best interest ot the City to approve <br />such petition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and <br />the right-ot-way described as tollows is hereby vacated: <br /> <br />See attached Exhibit A <br /> <br />With the tollowing condition: <br /> <br />The property owner ot Lot 1, Block 1, grant an additional 30 toot easement <br />along the south side ot the right-ot-way tor 215th Avenue tor streets, <br />drainage and utilities. <br /> <br />Adopted by the Elk River City Council this 1th day ot May, 1999. <br /> <br />Stephanie Klinzing, Mayor <br /> <br />ATTEST: <br /> <br />Sandra Peine, City Clerk <br /> <br />\ \ELKRIVER\SYS\SHRDOC\DOCUMENT\RESOLUTI\ev99-2.doc <br />
