City Council Minutes Page 7 April 17, 2017 ----------------------------- Motion carried 5-0. 7.9 Simple Plat: John Lenz, Elk River Screw Job Mr. Carlton presented the staff report. Mayor Dietz opened the public hearing. Jim Neilson, real estate attorney representing Mr. Lenz – provided a history of the property. He stated he believes it was the city’s error the original condition was not complied with and believes the city should overlook the requirement for Mr. Lenz to acquire Outlot B or the city should acquire Outlot B. Attorney Beck explained he does not recommend compounding the issue by approving the plat without meeting the condition requiring direct access to a city street. He noted the conditions of approval are a matter of public record and the applicant should have been aware the condition existed. He recommended continuing this item for a month giving the applicant time to acquire the appropriate frontage. Mayor Dietz asked if Attorney Beck and Mr. Neilson could work the issue out in a month. Mr. Beck indicated he hopes so. There was no one else to speak to this issue Moved by Councilmember Westgaard and seconded by Councilmember Olsen to continue the public hearing to May 15, 2017. Motion carried 5-0. 7.10 Ordinance Amendment: Keeping of Chickens in Residential Areas Mr. Carlton presented the staff report. Mayor Dietz opened the public hearing. There was no one to speak to this issue. Moved by Councilmember Wagner and seconded by Councilmember Westgaard to continue the public hearing to May 15, 2017. Motion carried 5-0. 7.11 Ordinance Amendment: Wetland Setback Regulations Mr. Carlton presented the staff report. Mayor Dietz opened the public hearing. There being no one to speak to this issue, Mayor Dietz closed the public hearing.
