City Council Minutes Page 7 <br />April 17, 2017 <br />----------------------------- <br />Motion carried 5-0. <br /> <br />7.9 Simple Plat: John Lenz, Elk River Screw Job <br /> <br /> Mr. Carlton presented the staff report. <br /> <br /> Mayor Dietz opened the public hearing. <br /> <br /> Jim Neilson, real estate attorney representing Mr. Lenz – provided a history of the <br />property. He stated he believes it was the city’s error the original condition was not <br />complied with and believes the city should overlook the requirement for Mr. Lenz to <br />acquire Outlot B or the city should acquire Outlot B. <br /> <br /> Attorney Beck explained he does not recommend compounding the issue by <br />approving the plat without meeting the condition requiring direct access to a city <br />street. He noted the conditions of approval are a matter of public record and the <br />applicant should have been aware the condition existed. He recommended <br />continuing this item for a month giving the applicant time to acquire the appropriate <br />frontage. <br /> <br /> Mayor Dietz asked if Attorney Beck and Mr. Neilson could work the issue out in a <br />month. Mr. Beck indicated he hopes so. <br /> <br /> There was no one else to speak to this issue <br /> <br /> Moved by Councilmember Westgaard and seconded by Councilmember <br />Olsen to continue the public hearing to May 15, 2017. <br /> <br />Motion carried 5-0. <br /> <br />7.10 Ordinance Amendment: Keeping of Chickens in Residential Areas <br /> <br /> Mr. Carlton presented the staff report. <br /> <br /> Mayor Dietz opened the public hearing. There was no one to speak to this issue. <br /> <br />Moved by Councilmember Wagner and seconded by Councilmember <br />Westgaard to continue the public hearing to May 15, 2017. <br /> <br />Motion carried 5-0. <br /> <br />7.11 Ordinance Amendment: Wetland Setback Regulations <br /> <br /> Mr. Carlton presented the staff report. <br /> <br />Mayor Dietz opened the public hearing. There being no one to speak to this issue, <br />Mayor Dietz closed the public hearing. <br /> <br />
