<br />Carson Business Park/I' 04-11 <br />February 22, 2005 <br /> <br />Page 4 <br /> <br />The applicant responded to the Commission's concern about the traffic impacts. He <br />indicated that he would be willing to discuss adjusting the design of the access into his site, <br />and modify the uses so that the traffic generated by his project would be reduced. However, <br />he felt that the traffic in this area will increase and the level of service will deteriorate even if <br />his project is not approved. <br /> <br />Recommendation <br /> <br />Staffs recommendation to the Planning Commission was to recommend denial or approval <br />with conditions. The main condition being that the traffic issues outlined in the City <br />Engineer's memo being addressed. <br /> <br />The Commission did not feel that the applicant adequately addressed the traffic issue and <br />recommended denial of this preliminary plat based on the following findings: <br /> <br />1. The proposed plat will endanger public safety because of the lack of public <br />infrastructure to support development of the proposed plat. <br />2. The proposed plat does not make adequate provision for transportation. Per the <br />traffic study submitted by the applicant's engineer, the level of service of the south <br />leg at the Carson and Main Street intersection will be a level of service F following <br />the development of the proposed plat. <br /> <br />Should the Council decide to approve the preliminary plat, the approval should include the <br />following conditions: <br /> <br />1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL <br />AND INSTALLATION OF IMPROVEMENTS PRIOR TO RELEASING THE <br />PLAT FOR RECORDING. <br /> <br />2. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF <br />100% OF THE COSTS OF PUBLIC IMPROVEMENTS. <br /> <br />3. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM <br />ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% <br />OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY <br />FOR A ONE YEAR PERIOD. <br /> <br />4. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY <br />THE CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING <br />THE PLAT FOR RECORDING. <br /> <br />5. SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY <br />ENGINEER BE PAID TO THE CITY PRIOR TO RELEASING THE PLAT FOR <br />RECORDING. <br /> <br />6.
