• threats, demands or suggestions that an employee's work status, <br /> advancement or other terms and conditions of employment are <br /> contingent upon the employee's toleration of or acquiescence to <br /> unwelcome sexual advances; <br /> • repeated, unwelcome sexual flirtations, propositions, or invitations to <br /> social engagements; or <br /> • unwelcome and objectionable physical contact or physical proximity. <br /> Scope of Policy <br /> The Utilities prohibits harassment of any type or form. This policy prohibits same sex <br /> harassment as well as harassment by members of the opposite sex. In addition,this policy <br /> prohibits sexual harassment and any other form of harassment by any individual, including <br /> Utilities managers, employees, co-workers, and third parties such as clients, elected <br /> officials, consultants, contractors or vendors who deal with the Utilities' employees. <br /> Procedure for Reporting Harassment <br /> The Utilities wants to resolve any problems,but it can do so only if it is aware of them. The <br /> Utilities encourages any individual who believes he/she is being harassed to report any and <br /> all incidents of perceived harassment. <br /> If at any time you feel you are being harassed, you should immediately contact: <br /> your supervisor; and/or <br /> another Utilities manager (including any superintendent of the Utilities or other <br /> representative as defined in Section 22 of this Handbook); and/or <br /> the Human Resources Representative (at the City of Elk River). <br /> Any Utilities manager or other person who receives a report under this policy is required to <br /> communicate the matter to the Human Resources Representative immediately. <br /> Your report of harassment may be oral or written; in either case, it is important that you <br /> state that your report is being made under this harassment policy, or that it concerns <br /> harassment. You may choose to whom you make the report;that choice,however,must be <br /> made from the list of individuals named above. <br /> The Utilities will promptly investigate harassment complaints as appropriate, and take <br /> other appropriate action. Any person who is found to have committed prohibited <br /> harassment will be subject to corrective action up to and including termination. <br /> Confidentiality—No Retaliation <br /> The Utilities will strive to protect the confidentiality of information the Utilities receives <br /> pursuant to this policy to the extent feasible and to the extent permitted by law. <br /> 5 <br /> November 2015 <br /> March 2017 <br /> 123 <br />
