<br />Memo to City Council/P 99-6, CD 99-5 <br />March 15, 1999 <br />Page 4 <br /> <br />. <br /> <br />Staff requested that deciduous overstory trees be planted in the parking <br />islands to provide shade. The applicant felt it best to keep the lights in the <br />parking islands and provide ornamental trees rather than deciduous. <br /> <br />Park and Recreation Commission Recommendation <br /> <br />On February 10, the Park and Recreation Commission reviewed the plat for <br />park dedication and recommended a fee in lieu of land to satisfy the park <br />dedication requirements. <br /> <br />Planning Commission <br /> <br />On February 24,1999, the Planning Commission recommended approval <br />siting staffs memo with the following additional condition: <br /> <br />. THAT THERE BE NO OUTSIDE STORAGE OF DONATED ITEMS. <br /> <br />Other Planning Commission comments included concerns regarding <br />screening from the proposed Hillside Estates 8th Addition. <br /> <br />At the public hearing no one spoke for or against the proposal. <br /> <br />. Recommendation <br /> <br />Staff recommends that the Planning Commission recommend approval of the <br />request by Phoenix Enterprises for the following: <br /> <br />A) Preliminary and final plat of approximately 6.62 acres into 2 commercial: <br />lots with the following conditions: <br /> <br />1. THAT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO THE CITY <br />AS DIRECTED BY' THE CITY ENGINEER, PRIOR TO THE RELEASING <br />THE PLAT FOR RECORDING. <br /> <br />2. PARK DEDICATION BE PAID IN THE AMOUNT REQUIRED BY THE CITY <br />AT THE TIME OF FINAL PLAT AND PRIOR TO THE RELEASING THE <br />PLAT FOR RECORDING. <br /> <br />3. SURFACE WATER MANAGEMENT FEE BE PAID IN THE AMOUNT <br />REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT AND PRIOR TO <br />THE RELEASING THE PLAT FOR RECORDING. <br /> <br />4. A WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT <br />BE PAID TO ELK RIVER MUNICIPAL UTILITIES AT THE TIME OF FINAL <br />PLAT AND PRIOR TO THE RELEASING THE PLAT FOR RECORDING. <br /> <br />.
