<br />. <br /> <br />(e) <br /> <br />There will be no general moratorium imposed by any governmental <br />authority with respect to the issuance of building permits affecting <br />the development of the Property or sanitary sewer, water, natural <br />gas or electricity connections with respect to the Property; <br /> <br />(f) Prior to closing Buyer shall have obtained, at its sole cost, the <br />report of a duly licensed soil engineer with respect to the soil <br />conditions of the Property or as much thereof as Buyer deems <br />necessary, and Buyer, in "its sole discretion, shall be satisfied <br />with the form and content of such report; <br /> <br />(g) Prior to closing Buyer shall have obtained commitments from <br />providers of utility services in form and content solely acceptable <br />to Buyer insuring adequate sanitary sewer, storm sewer, water, <br />natural gas, electricity, and telephone service to accommodate <br />Buyer's ~ntended use of the Property; <br /> <br />(h) If required bv any governmental authority, Buyer shall have the <br />right, but not the obligation to authorize and complete an <br />Environmental Assessment Worksheet or Environmental Impact Statement <br />the results of which would allow Buyer, at Buyer's sole discretion, <br />to go forward with Buver's development of the Property; <br /> <br />(i) <br /> <br />. <br /> <br />(j) <br /> <br />(k) <br /> <br />(1) <br /> <br />. <br /> <br />Prior to closing, Buyer shall have obtained from requisite <br />governmental authorities unconditional approval for reasonable <br />access to the Property which is sufficient for the Buyer's <br />development of the Property, except for additional access to U. S. <br />Highway No. 169, which both parties acknowledge to be inattainable <br />or unreasonably difficult to obtain. <br /> <br />Buyer shall determine, in its sole discretion, that it will only <br />have to pay for (or be assessed) the actual costs of the utilities <br />to the Property, ahd not the area wide utility costs and/or the <br />cost of any lift station(s) or other utility improvements necessary <br />for area wide service. Buyer will use reasonable efforts to <br />negotiate with the City or other governmental authority regarding <br />the cost for utilities. <br /> <br />Within ten days from the date of the execution of this Agreement, <br />Sellers shall properly serve each and every resident of the <br />manufactured home park currently residin~ on the Property the notice <br />required by Minnesota Statutes, and Minnesota Rules and Regulations, <br />regarding their vacation from the Property and relocation to another <br />property. Those obligations herein are not contingent upon Seller <br />finding an alternative site to relocate the current manufactured <br />home park residence. <br /> <br />Prior to closing, Buyer shall determine, at its sole discretion, <br />that there will be no ponding, wetlands, public water or sensitive <br />ground water', area on the Property required or defined by the City <br />of Elk River, or any other governmental authority, except as may <br />be replaced by an approved replacement plan. <br /> <br />-6- <br />
