<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 99- <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br />AUTHORIZING THE CLOSING OF THE RAILROAD CROSSING ON <br />173RD AVENUE AND THE PRIVATE CROSSING SOUTH OF 171sT AVENUE <br /> <br />WHEREAS, the City has worked with Burlington Northern and Santa Fe Railway to approve a <br />new railroad crossing at 171st Avenue; and <br /> <br />WHEREAS, Burlington Northern and Santa Fe Railway has made the opening of the new <br /> <br />crossing at 171st Avenue contingent upon closing the existing railroad crossing <br />on 173rd Avenue and private crossing south of 171st Avenue; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: <br /> <br />1. <br /> <br />At the time that the 171st Avenue railroad crossing is opened to traffic both the 173rd <br />Avenue crossing and the private crossing south of 171 st Avenue shall be closed and the <br />easement for the 173rd Avenue crossing within the railroad right-of-way shall be vacated. <br /> <br />Passed and adopted this 16th day of February, 1999. <br /> <br />Stephanie A.
