COUNCILMEMBER <br />KUESTER SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br /> <br />? <br />Revised Snowmobile Ordinance – Ms. McPherson reviewed the proposed new <br />snowmobile ordinance. <br /> <br />Mayor Klinzing inquired how penalties would be enforced. Ms. McPherson stated that it <br />would be at the discretion of the police department just as they enforce other laws. <br /> <br />COUNCILMEMBER TVEITE MOVED TO ADOPT ORDINANCE 01- 11 OF <br />THE CITY OF ELK RIVER REPEALING ALL OF THE EXISTING <br />SECTION 1104 OF THE CITY CODE OF ORDINANCES AND ADOPTING <br />A NEW SECTION 1104. COUNCILMEMBER DIETZ SECONDED THE <br />MOTION. THE MOTION CARRIED 5-0. <br /> <br />5.4. Discuss Funding for 171Avenue Signal Modification <br /> <br /> <br />City Administrator Pat Klaers stated that the city engineer received a letter from Mississippi <br />Ridge Developer Scott Powell. Mr. Klaers stated that Mr. Powell would like the city to pay <br />the cost for a signal arm at the intersection of Highway 10 and 171 Avenue. <br /> <br />Scott Powell, developer of Mississippi Ridge – Read the letter that he previously submitted <br />to the city engineer. Mr. Powell stated that he was surprised to hear that he had to pay for <br />the cost of this signal arm. He believed the cost to be significant and unfair. Mr. Powell <br />stated that the city should pay 50% of the cost and MnDOT should pay 50%; MnDOT has <br />already paid two-thirds of the cost of the signal that is there. Mr. Powell stated that he paid <br />to close four entrances to the highway and for an extra parcel of land for safety on the <br />highway. Mr. Powell stated that this signal arm would be a benefit to property owners to the <br />north and to traffic traveling along Highway 10. <br /> <br />Mayor Klinzing inquired if MnDOT covered two-thirds of the cost of the signal project. Mr. <br />Klaers stated that he couldn’t verify these costs at this time. <br /> <br />Councilmember Motin stated that if Mr. Powell’s development weren’t going into this <br />location there would not be a need for this signal to be modified with a fourth arm. <br /> <br />Mayor Klinzing and Councilmember Dietz indicated that they were not comfortable making <br />a decision on this issue until the city engineer was present. This item was postponed until <br />the September 10, 2001, City Council meeting. <br /> <br /> <br />5.5.Consider Conduit Bond Policy <br /> <br />City Administrator Pat Klaers reviewed the Conduit Bond policy. <br /> <br />COUNCILMEMBER TVEITE MOVED TO ADOPT THE CONDUIT BOND <br />POLICY. COUNCILMEMBER MOTIN SECONDED THE MOTION. THE <br />MOTION CARRIED 5-0. <br /> <br /> <br />
