Box 490 <br />Elk River, MN 55330-0490 <br /> <br />RE: RICHARD BURY <br />ADMINISTRATIVE SUBDIVISION <br /> <br />Dear Council Members: <br /> <br />Richard Bury is ,:;Jroposing an administrative subdivision of his approximately 40-acre parcel of land located <br />along 221st Avenl.le at the intersection of the City trail easement. Mr. Bury is proposing to subdivide the <br />pn;)perty into three parcels. One parcel is west of the City trail, the second parcel is east of the trail but north of <br />22151 Avenue. ar:j the final parcel is south of 22181 Avenue. This administrative subdivision was presented to <br />ta City Council at a meeting in December. At that meeting the land owner to the west of the Bury property <br />ed a concerr. regarding whether or not there was access from Quinn Street to Parcel A. The landowner felt <br />at he owned a 7.foot wide strip of land that would preclude Mr. Bury from accessing Parcel A from Quinn <br />Street. The City ':ouncil deferred any action on the Bury Administrative Subdivision and directed staff to <br />review the information the landowner to the west could provide relative to the survey of his property. That <br />sutvey was submitted and reviewed together with the survey of the Bury property. It is our opinion that there is <br />no strip of land precluding access to the Bury property from Quinn Street. Both surveys show the property line <br />in questions to b~; the same section line. If the landowner from the west feels he still has some right to <br />prc,perty in this area, he certainly has other remedies through the court system. <br /> <br />The one other is:.ue we noted in reviewing this revised drawing is the trail easement is shown to narrow. <br />There was some discrepancy in the previous drawing over the location of the trail. As that was cleared up, the <br />trail was shown ~l::: 100 feet in width, centered on the old railroad track alignment. In actuality. the easement is <br />200 feet wide antJ should be 100 feet each side of the old centerline of the railroad tracks. We have discussed <br />this issue with Mr. Bury and he has indicated that he will have his surveyor revise the drawing and have it <br />aVedlable at or before Tuesday evening's meeting.
