Regarding taxes,Mr. Kepler stated the city extracts a substantial contribution <br /> towards infrastructure in lieu of any industrial taxes payment. <br /> Commissioner Larson-Vito noted that just because the land is developed, there are vacant <br /> structures that need to be considered. <br /> Chair Johnson indicated he was a member of the Planning Commission in 2010 when the <br /> original request was opposed and stated he knows the reasons why it was not a good fit in <br /> the area. He struggles with whether or not they continue to delay future expansion or decide <br /> to put a cap on expansion plans. <br /> Commissioner Larson-Vito stated the Planning Commission has guidelines in place for a <br /> reason and should remain consistent on how they apply them. She stated she understands <br /> the conundrum but felt there are definitely grounds for denial of the applicant's request. <br /> Mr. Carlton stated if the commission sees the potential for significant impacts on the area, <br /> the commission should state, specifically,what conditions for approval of a CUP have not <br /> been met. <br /> The commission reviewed the conditions for approval of a CUP and noted that items 1, 3,4, <br /> and 5 were not met. <br /> Motion by Commissioner Larson-Vito and seconded by Commissioner Thiel to <br /> recommend denial of the request by Spectrum High School for a Conditional Use <br /> Permit based upon the Applicable Regulations not in compliance with the following <br /> conditions: <br /> 1)Will not endanger, injure or detrimentally affect the use and enjoyment of <br /> other property in the immediate vicinity or the public health, safety, morals, <br /> comfort, convenience, or general welfare of the neighborhood or the city. <br /> 3)Will not impede the normal and orderly development and improvement of <br /> surround vacant property. <br /> 4)Will be served adequately by and will not adversely affect essential public <br /> facilities and services including streets,police and fire protection, drainage, <br /> refuse disposal,water and sewer systems,parks and schools; and will not, in <br /> particular, create traffic congestion or interference with traffic on adjacent and <br /> neighboring public thoroughfares. <br /> 5) Will not involve uses, activities,processes, materials, equipment and <br /> conditions of operation that will be detrimental to any persons or property <br /> because of excessive traffic,noise, smoke,fumes,glare, odors, dust or <br /> vibrations. <br /> Motion carried 5-0. <br />
