Staff recommends locating the <br /> trail on the west side of Elk Lake Rd. <br /> Parks and Recreation Commission - October 12, 2016 <br /> The Parks and Recreation Commission, on October 12, 2016,recommended Park Dedication be paid for <br /> one dwelling unit. The current rate is $1,425.93 per dwelling unit. Staff will determine the final amount <br /> when the plat is released for recording. <br /> On October 12, 2016, the Parks and Recreation Commission was made aware of the topography, curves, <br /> and other physical features along this area. The Commission recommended (7-0) that a trail easement be <br /> required along the western side of the subject property (i.e., east side of Elk Lake Rd NW). No direction <br /> on easement width was provided. The City Council approved the plat on October 17, 2016,with the <br /> Park and Recreation Commission recommendation to include a trail easement, again no easement width <br /> was specified. <br /> City Council Meeting- November 21, 2016 <br /> During the Open Forum at the November 21, 2016, City Council meeting, the applicant spoke, stating <br /> they were confused about the approved trail easement. As they interpret the tail location of the Parks <br /> Master Plan to be along the west side of the road, the applicant questioned why an easement was required <br /> when their property is on the east side of the road. The City Council directed the applicant to reapply for <br /> the plat requesting the trail easement on the property to be removed. <br /> Parks and Recreation Commission - December 14, 2016 <br /> On December 14, 2016, the Parks and Recreation Commission re-reviewed the application. <br /> The applicants spoke during the public hearing and questioned how the city can require an easement on <br /> the east side of Elk Lake Road when the Master Plan shows a future trail that appears to be on the west <br /> side of Elk Lake Road. They stated that if the intent was to leave opportunities for interpretation of a <br /> future trail location, the map is unclear and misleading to the public. They also questioned how the city <br /> can require a cash dedication for Park Dedication, as well as an easement for public use. They <br /> understand they own the land under the easement but when a trail is constructed on their property for <br /> the public,it becomes "public land" and not just their land. They feel it is two forms of dedication. <br /> The Commission recommended (4-3) that a 10-foot trail easement be required along the western side of <br /> Lot 2 Block 1 of the proposed plat (i.e., east side of Elk Lake Rd NW). <br /> Applicable Regulation <br /> Approval of a plat may only be ordered if the following findings have been made, as outlined in Section <br /> 30-375: <br /> 1.
