<br />Request for Action <br /> <br /> <br />To <br />Parks and Recreation Commission <br />Item Number <br />X.X <br />Agenda Section <br />Action Items <br />Meeting Date <br />December 14, 2016 <br />Prepared by <br />Steve Benoit, Recreation Manager <br />Item Description <br />Whiteoak Plat - Park Dedication and Trail <br />Easement <br />Reviewed by <br />Michael Hecker, Parks and Recreation Director <br />Chris Leeseberg, Senior Planner <br />Reviewed by <br />Cal Portner, City Administrator <br /> <br />Action Requested <br />Recommend, by motion, park dedication for the Whiteoak Plat as cash for one dwelling unit at the City <br />Council-established rate when the subdivision is released for recording. <br /> <br />Background/Discussion <br />On October 12, 2016, the Parks and Recreation Commission reviewed this preliminary plat and <br />recommended Park Dedication be paid in the form of cash as well as provide an unspecified width of <br />land along the western side of the subject property. <br /> <br />On October 17, 2016, the City Council approved the Final Plat with the following conditions: <br />1. Park Dedication Fee shall be paid for one dwelling unit at the rate applicable when the <br />subdivision is released for recording. The current rate for low density residential is $1,425.93 per <br />dwelling unit. <br />2. Surface Water Management Impact Fee shall be paid for one dwelling unit at the rate applicable <br />when the subdivision is released for recording. The current rate is $113 per lot. <br />3. The plat shall not be released until the wetland delineation is approved by the Technical <br />Evaluation Panel and updated as directed. <br />4. Submittal of written approval from Sherburne County permitting an additional driveway for the <br />new parcel. <br />5. Staff approval of all required development and grading plans. <br />6. A trail easement shall be required along the entire western side of the subject property. <br /> <br />On November 21, 2016, Deb and Roger Whiteoak spoke during the City Council Open Forum indicating <br />they were confused why an easement was being required when the Master Plan does not contain trails on <br />their side of the road? They asked if it could be amended because they did not want to provide the <br />easement for the following reasons: <br />• The Council approved Parks and Recreation Master Plan clearly indicates “Other Future Trails” <br />along the west side of Elk Lake Road. <br />• Providing a 20-foot wide easement along the entire western property line would be providing <br />about 1 acre of additional land above and beyond the cash dedication. <br />• A trail installed in this area would take out all of the trees that provide the buffer from County <br />Road 1. <br />
