THAT ACCESS TO THE PROPERTY BE LIMITED TO THE ULYSSES STREET RIGHT -OF- <br />WAY. <br /> <br />COUNCILMEMBER FARBER SECONDED THE MOTION. <br /> <br />COUNCILMEMBER MOTIN MOVED TO AMEND THE MOTION TO CHANGE ITEM #6 TO <br />READ AS FOLLOWS: <br /> <br />. <br /> <br />THE DUMPSTER SHALL BE LOCATED IN THE 5OX20 ENCLOSURE NOTED ON THE SITE <br />PLAN DATED 9/27/00 CONSTRUCTED OF CHAIN LINK FENCE WITH SLATS. ONCE <br />EXPANSION OF THE BUILDING IS COMPLETED A PERMANENT DUMPSTER ENCLOSURE <br />LOCATION BE CONSTRUCTED OF SIMILAR MATERIALS AS THE BUILDING ALONG WITH <br />A GATE. IT IS REQUIRED THAT THE TEMPORARY ENCLOSURE BE REPLACED WITH A <br />PERMANENT ENCLOSURE WITHIN 5 YEARS IF THERE IS NO EXPANSION DONE. <br /> <br />COUNCILMEMBER DIETZ SECONDED THE AMENDMENT. THE MOTION <br />FAILED 2-2. Councilmembers Thompson and Farber opposed. <br /> <br />Vice Mayor Motin called for the vote on the original motion. <br /> <br />THE MOTION CARRIED 3-1. Reauest bv Sian Art Co. for aConditional Use Permit to Amend the Elk Park Center <br />Planned Unit Develooment (PUD) Agreement to Allow a 2nd Wall Sian. Public <br />Hearina - Case No. CU-34 <br /> <br />Planner Steve Wensman stated that Sign Art Company, representing Caribou <br />Coffee. is requesting a conditional use permit to amend the Elk Park Center PUD <br />Sign Agreement to allow a second sign. Mr. Wensman stated that the Elk Park <br />Center constructed new retail space in 1999 that faces to the north rather than <br />the. east and has limited visibility. <br /> <br />Vice Mayor Motin opened the public hearing.
