EGty1� ,.,�� Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 4.11 <br /> Agenda Section Meeting Date Prepared by <br /> Consent November 21, 2016 Amanda Othoudt,Director,ED <br /> Item Description Reviewed by <br /> Joplin Avenue Project: Resolution for Property Cal Portner, City Administrator <br /> Easement Conveyance Reviewed by <br /> Action Requested <br /> Adopt,by motion, a resolution authorizing the purchase and release of state highway easements located at <br /> the intersection of US Hwy 10 and Joplin Street NW. <br /> Background/Discussion <br /> Over the past several months, staff has been working with our attorney and MnDOT to negotiate the <br /> purchase and release of the state highway easement located at the intersection of US Hwy 10 and Joplin <br /> Street NW in order to acquire vacant properties for development and obtain marketable title to the <br /> properties. <br /> Staff has received a quitclaim deed from MnDOT that will extinguish the highway easement on the <br /> remnant parcels of the property. The terms of MnDOT's offer to convey the highway easements are set <br /> forth in the attached Exhibit A which outlines MnDOT's access and signage restrictions. <br /> Staff has reviewed the quitclaim deed with our attorney and has determined that MnDOT's terms of <br /> conveyance of the highway easements are reasonable and generally consistent with the city's proposed <br /> uses for the properties,but that negotiations may be necessary to clarify the scope of MnDOT's signage <br /> restrictions. <br /> Staff, along with our attorney,will take all steps necessary on behalf of the city to finalize the conveyance of <br /> the MnDOT Easements and negotiate the final terms of the conveyance. <br /> Financial Impact <br /> MnDOT is requesting$8,060 for the purchase and release of the old highway easement which will be <br /> paid out of the City Development Fund.
