5. Drainage. The AGENCY agrees to allow BNSF to drain water from the 171st St Street <br />crossing area into existing AGENCY storm sewers, if such storm sewers are available. Drain pipes and <br />filter fabric necessary for such drainage will be furnished and installed by BNSF. <br /> <br />6. Roadway Surfacing Work. The AGENCY agrees to provide, at its sole cost and <br />expense, enough asphalt to cover the distance between the existing roadway surface at 171st St Street and <br />the new crossing surface on both sides of the track as well as the area between the tracks. The principal <br />elements of AGENCY’s Work are as follows: <br /> <br />(a) Installation of a pavement marking stop bar in accordance with the Manual on Uniform <br />Traffic Control Devices (hereinafter called, “MUTCD”); <br /> <br />(b) Installation of advance warning signs in accordance with the MUTCD; <br /> <br /> <br />(c) Job site cleanup including removal of all construction materials, concrete debris, surplus <br />soil, refuse, contaminated soils, asphalt debris, litter and other waste materials to the <br />satisfaction of BNSF. <br /> <br />7. Contractor Requirements: AGENCY must require its contractor to comply with the <br />obligations set forth in this Agreement, including Exhibit C and Exhibit C-1, and incorporate in each <br />prime contract for construction of the Project, or the specifications therefor, the provisions set forth in <br />Exhibit C and Exhibit C-l, attached hereto and by reference made a part hereof. <br /> <br />No work shall be commenced within BNSF’s right of way until the AGENCY’s contractor shall have (i) <br />executed and delivered to BNSF an agreement in the form of said Exhibit C-1 and (ii) delivered to and <br />secured BNSF’s approval of the required insurance. <br /> <br />8. Term. This Agreement begins on the effective date set forth above and remains in effect <br />until completion of all work contemplated in this Agreement and AGENCY’s payment of the amounts set <br />forth in Section 2 above.
