MEMORANDUM <br />TO: City Council <br />FROM: Tina Allard, City Clerk <br />DATE: April 14, 2008 <br />SUBJECT: Review of Tobacco, Solicitor's, and Sexually -Oriented <br />Businesses Licensing Ordinances <br />Item 5.3. <br />Tobacco Ordinance <br />The city currently has a moratorium in effect for licensing tobacco product shops in order to <br />consider amendments to the ordinance. <br />Council requested review of the following: <br />The Council requested the city attorney address drug paraphernalia. <br />Proximity to schools. <br />More stringent measures for second-hand smoke in tobacco product shops. <br />Transient Peddler's and Solicitor's Ordinance <br />This ordinance has been reorganized so it flows better. The restrictions put on APX Alarm <br />have been added to the ordinance. The Council requested a review of this ordinance in order <br />to consider more restrictions on solicitors. <br />Sexually Oriented Businesses Licensing Ordinance <br />History <br />Prior to adopting ordinances, cities must engage in legislative fact-finding that establishes <br />adult uses as having undesirable secondary effects. The Planning Commission and City <br />Council completed this fact-finding process in 1992. Per the city zoning ordinance, these <br />types of businesses are allowed as a conditional use in the 1-1 (Light Industrial) and I-2 <br />(Medium Industrial) zoning districts.
