EOty1� ,.,�� Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 4.7 <br /> Agenda Section Meeting Date Prepared by <br /> Consent September 19, 2016 Zack Carlton,Planning Manager <br /> Item Description Reviewed by <br /> Resolution for the Reconveyance of Forfeited Land Tina Allard, City Clerk <br /> to the State of Minnesota by the City of Elk River Reviewed by <br /> Cal Portner, City Administrator <br /> Action Requested <br /> Adopt,by resolution, the reconveyance of city-owned property (75-125-4201). <br /> Background/Discussion <br /> The city acquired the tax forfeited property in 2012 for use as possible right-of-way when the adjacent <br /> properties developed. The parcel is a remnant piece that remained after the re-alignment of Cleveland <br /> Street. Schematic development plans for the area do not utilize this parcel for road right-of-way and the <br /> best use of the property would be incorporation into adjacent development. <br /> The state deed for the conveyance of forfeited lands has a restriction on it stating it shall be used <br /> exclusively for right-of-way. The new property owner will need to have those rights vacated when <br /> development of the area occurs. <br /> The city cannot sell the property but can reconvey it back to the state and once approved by the <br /> Department of Revenue the parcel would be available for the next public sale. <br /> Financial Impact <br /> There are costs associated with recording the reconveyance with the county are approximately$50. <br /> Attachments <br /> ■ Location Map <br /> ■ Resolution <br /> POWERED 6T <br /> AR <br />
