<br />ORDINANCE 04 _ 21 <br />CITY OF ELK RIVER <br /> <br />AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING <br />SECTIONS 30-793 AND 30-803 <br />OF THE CITY CODE OF ORDINANCES <br />RELATING TO ACCESSORY BUILDINGS AND TO ANIMALS <br /> <br />Case No. OA 04-06 <br /> <br />The City Council of the City of Elk River does hereby ordain as follows: <br /> <br />Section 1. Section 30-793 titled Accessory buildings of the City of Elk River Code of <br />Ordinances shall be amended by adding the following: <br /> <br />Sec. 30-793. Accessory buildings. <br /> <br />(a) Time of construction. No accessory building or structure shall be constructed on <br />any residential lot prior to the time of construction of the principal building to which it is <br />accessory. <br />(b) R-Ia district. In the R-Ia zoning district, two detached accessory buildings are <br />allowed per single-family parcel. Restrictions on the number of agricultural accessory <br />structures shall not apply to parcels that are 40 acres or larger. The total area of attached <br />garages and accessory buildings shall not exceed the following maximum square footage: <br /> <br />TABLE INSET: <br /> <br />Parcel size <br />Less than 1 acre <br />1 acre to <br />2.5 acres to <br />5 acres to <br />10 acres to <br />20 acres to <br />40 acres or more <br /> <br />Maximum Accessory Structure Area <br />2,000 sq. ft. attached and detached <br />2,500 sq. ft. attached and detached <br />3,000 sq. ft. attached and detached <br />4,000 sq. ft. attached and detached <br />8,000 sq. ft. attached and detached <br />16,000 sq. ft. attached and detached <br />Not to exceed 2% of the lot area <br /> <br />Section 2. Section 30-803 titled Animals of the City of Elk River Code of Ordinances shall <br />be amended by amending the following: <br /> <br />Section 30-803. Animals <br /> <br />(a) Definitions. The definitions in section 30-1 are applicable in this section. <br />(b) Purpose. It is the intent of this section to establish regulations which will allow the <br />keeping of animals within the city in a safe, clean, and healthy manner. The city recognizes <br />that certain types of animals require regulations and standards to ensure tl1at the health, <br />safety, and welfare of the public is protected and to promote the compatibility of land uses <br />as it relates to the keeping of animals. <br />(c) Applicability of other regulations. The provisions of this section relate to the <br />regulation of animals in the context of land use compatibility. These standards and <br />provisions are not exclusive of other regulations set forth in this Code. The provisions of <br />
