2. The Conditional Use Permit is not a building permit and all required sign permits must be <br /> approved by the building department prior to any construction activities on site. <br /> 3. Submittal of plans and specifications outlining compliance with the standards set forth in Sec. 30- <br /> 864 (e). <br /> Background/Discussion <br /> Case No. P 16-06 & CU 16-16 <br /> The City Council reviewed the plat and CUP requests during their June 20, 2016, meeting. During that <br /> meeting the applicant requested additional time to review staff s request to dedicated right-of-way along <br /> the south and west sides of the proposed plat. The public hearing was closed and the discussion was <br /> continued to a later date. <br /> Since that meeting, staff has been working with the applicant to resolve their concerns with dedicating <br /> right-of-way and construction of a future road connection. Specific concerns included future assessments <br /> for the extension of Business Center Drive, and a reduction to the buildable area of the parcel south of <br /> the requested right-of-way (Outlot B,Elk Path Business Center). <br /> Future Assessments <br /> Staff evaluated the likelihood for future assessments to be levied against the property under the <br /> current/planned use as a stormwater pond with a single billboard. Staff cannot identify a benefit to the <br /> property in its current state, and recommends a condition in the Final Plat resolution stating the property <br /> will not be assessed provided it remains in its current state. <br /> Development on Adjacent Lot <br /> Dedication of land on Outlot B,Elk Path Business Center is not included as a condition of approval,but <br /> will be when it is platted in the future. The applicant has identified land west of the parcel,part of the <br /> previous alignment of Waco Street,which would allow them to expand the useable area of the parcel. An <br /> application to vacate that right-of-way can be made,and would be reviewed by the City Council at that <br /> time. <br /> Development Fees <br /> The applicant has requested the park dedication and surface water management fees be waived. Park <br /> Dedication fees are intended to cover the impacts new development has on the parks system. In this case, <br /> the addition of a billboard will not have any impact to the parks system as it is replacing an existing one, <br /> and staff recommends waiving the park dedication fee. <br /> The surface water management fee is intended to fund improvements to the city's stormwater system. <br /> The parcel is almost entirely comprised of a stormwater pond and staff supports waiving this fee. <br /> Statutory Review Period <br /> In accordance with State Statute 15.99 the required 60-day review period for the CUP was extended to <br /> August 23, 2016, and the 120-day review for the plat ends on August 23, 2016. <br /> Financial Impact <br /> None <br />
