CU 04-36 <br />December 20, 2004 <br />Page 2 <br /> <br />Standards for Issuance of a Conditional Use Permit <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br />location: <br /> <br />,. Wi/I not endanger, injure or detrimentally ciffect the use and enjoyment if other property in the <br />immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare if the <br />neighborhood or the city. <br />2. Will be consistent with the comprehensive plan. <br />3. Will not impede the normal and orderly development and improvement if surrounding vacant <br />property. <br />4. Will be served adequately by and will not adversely ciffect essential public facilities and services <br />including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks <br />and schools; and will not, in particular, create traffic congestion or interference with traffic on <br />adjacent and neighboringpublic thoroughfares. <br />5. Will not involve uses, activities, processes, materials, equipment and conditions if operation that will <br />be detrimental to any persons or property because if excessive traffic, noise, smoke, fumes, glare, <br />odors, dust or vibrations. <br />6. Will not result in the destruction, loss or damage if a natural, scenic or historic feature if major <br />importance. <br />7. Will fully comply with all other requirements if this Code, including any applicable requirements <br />and standards for the issuance if a license or permit to establish and operate the proposed use in the <br />city. <br /> <br />If denial of such a permit should occur, it shall accompany recommendations or <br />determinations by findings or a report stating how the proposed use does not comply with <br />the standards set forth in section 30-654. <br /> <br />Overview <br /> <br />The applicant would like operate a middle school at 555 Railroad Drive. The location of the <br />proposed facility will be within an existing building located on the site. They are utilizing <br />three rooms in the building, two class rooms and an office, about 2200 square feet. The <br />portion of the building was formally used by a Montessori school. Classes will run from 8: 1 0 <br />to 2:10 Monday - Friday. Currently only grade 7 is located at the site. Next year they plan to <br />add an 8" grade class and eventually add a 6" grade class. The entrance into the school is on <br />the east side of the building adjacent to the parking lot. There is a fenced playground area <br />located on the west side of the parking lot. The fenced area was installed as part of the <br />Montessori school. A basketball hoop may be installed but no playground equipment is <br />proposed. The bus drop-off and pick-up area is on the north side of the building along 3'" <br />Street. <br /> <br />Analysis <br /> <br />There were no concerns raised at the staff site plan review meeting.
