<br />Cleanup of the site. At our November 5, 2003 meeting, October 31, 2004 was set as the <br />deadline for the completion of the cleanup and testing to verify the cleanup of the site. <br />You contend that the delay in the approval of the investigation work plan by MPCA made it <br />impossible to meet this deadline. <br /> <br />Potential Brown Field Grant. You reiterated your desire to apply for a Department of <br />Employment and Economic Development (DEED) ''Brown Field" grant to aid financially <br />in the cleanup of the site. This topic was first discussed at an April 4, 2004 meeting. As <br />discussed with the potential developers of the site, the property is zoned residential and will <br />need to be developed into "Affordable Housing" to qualify for a DEED grant. City staff <br />cautions that the conversations held at our April 4, 2004 and September 22, 2004 meetings <br />should not be construed as city support for the concept of affordable housing on this <br />property or support for a brown field grant. This support can only come from the Elk River <br />City Council. The Elk River City Council will need to approve resolutions in support of the <br />grant and the concept of affordable housing on this site. Cathy Melelich is the lead city <br />contact for the DEED grant process and Michele McPherson is the lead city staff person to <br />pursue the plat concept as part of this process. <br /> <br />Removal of the buildings on the site. October 31, 2004 was set as a deadline for the removal <br />of the two building on the site. At our September 22, 2004 meeting you indicated a desire to <br />leave the pole barn structure on the property to store equipment that you will be using <br />during the cleanup of the contamination on the site. As discussed, you will need to be <br />properly certified through MPCA to perform the cleanup of the site. Past issues and <br />concerns with the current contamination on the site have elevated the level of concern <br />regarding your property. The issue of this structure remaining through the cleanup will need <br />to be discussed with the Elk River City Council. However, staff sees no reason for delay in <br />the removal of the other structure on the property. In the opinion of the Building <br />Department this building is dangerous and there is no reason to delay its removal. <br /> <br />New deadline for testing and cleanup of the property. In order to comply with DEED grant <br />deadlines (that no work on a qualifying project takes place earlier than six moths prior to <br />application) Bruce Johnson suggested the following new deadlines: <br />~ Testing begins after November 1, 2004. <br />~ A Remedial Action Plan (RAP) will be submitted to MPCA on or before April 30, <br />200S. MPCA has 60 days to approve the RAP, which they may amend. <br />~ Cleanup completed by August 31,2005. <br />~ Pole barn removed from site by October 31, 200S. <br />~ Certificate of Compliance copied to the city as soon as it is available. <br /> <br />Note: The City still expects the older white structure removed from the site by October 31, <br />2004. <br /> <br />City staff will get direction from the Elk River City Council regarding the issues discussed at <br />our September 22, 2004 meeting and relay their desires onto you. The Council may not <br />agree with supporting the grant and the new timetable and require that the activities listed <br />occur sooner. If you have any questions or feel the contents of this letter do not accurately <br />reflect what was discuss at our meeting, please call me. <br />
