Strikethroughs to be removed Underlines to be added Ordinance 16 - ____ An Ordinance Amending Chapter 30 of the City of Elk River, Minnesota, City Code of Ordinances to Permit Microdistilleries and Cocktail Room Uses The City Council of the City of Elk River does hereby ordain as follows: §, SECTION 1.That 30-01of the City of Elk River Code of Ordinances shall be amended to add the following definitions: Cocktail Room means a licensed operation, accessory to a permitted microdistillery use, where distilled spirits may be sold on-sale in accordance with state and local regulations. a state licensed distillery producing distilled spirits with a total quantity not to Microdistillery means exceed 40,000 proof gallons in a calendar year Proof gallon means one liquid gallon of distilled spirits that is 50 percent alcohol at 60 degrees Fahrenheit §, SECTION 2.That 30-1024 (c) and (d) of the City of Elk River Code of Ordinances shall be amended to add the following permitted and conditional uses: (c) Accessory uses. Accessory uses in the C-3 district are as follows: (7) Cocktail rooms (d) Conditional uses. Conditional uses in the C-3 district are as follows: (26) Microdistilleries §, SECTION 3.That 30-1292 (c) and (d) of the City of Elk River Code of Ordinances shall be amended to add the following permitted and conditional uses: (c) Accessory uses.
