The piling, storing, or keeping of old machinery, equipment, junk, <br />debris, or abandoned motor vehicles, shall be prohibited on this site. <br /> <br />Motion carried 5-0. <br /> <br />7.3. City of Elk River – Ordinance Amendment Relating to Wall Signage <br /> <br />Mr. Leeseberg presented the staff report for Case No. OA 16-04. <br /> <br />Mayor Dietz opened the public hearing. There being no one present to speak, Mayor <br />Dietz closed the public hearing. <br /> <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Wagner to adopt Ordinance 16-10 amending Section 30-1584 (MU-ERP mixed <br />use Elk River Plaza district) and adding Section 30-881 (MU-ERP mixed use <br />Elk River Plaza district) as outlined in the staff report. <br /> <br />Motion carried 5-0. <br /> <br />7.4. Midwest Asphalt – 12168 221 Avenue NW <br />st <br /> Conditional Use Permit for Mineral Excavation <br /> <br />Mr. Carlton presented the staff report. <br /> <br />Mayor Dietz opened the public hearing. There being no one to speak, Mayor Dietz <br />closed the public hearing. <br /> <br />Moved by Councilmember Wagner and seconded by Councilmember <br />Westgaard to approve the Conditional Use Permit, Case No. CU 16-10 for <br />st <br />Midwest Asphalt to expand operations at 12168 221 Ave. NW (PID 75-109- <br />1100) with the following conditions: <br />1. The Conditional Use Permit shall not be recorded until all applicable <br />conditions have been completed. <br />2. The expanded operations (portable hot mix asphalt plant and portable <br />aggregate wash plant) shall not begin until the Conditional Use Permit is <br />recorded. <br />3. If the authorized use ceases for more than six months, the Conditional <br />Use Permit shall expire. <br />4. The Conditional Use Permit is not a building permit and the applicant <br />must apply for and receive approval of required building and sign permits <br />before construction may begin. <br />5. Facilities shall meet all building and fire codes. <br />6. An updated MPCA Air Emissions Permit or written notice by the MPCA <br />that an updated permit is not required for the addition of the hot-mix <br />asphalt plant must be submitted for review. <br /> <br />
