13. Addition of a bituminous trail connecting Johnson Street with Ivanhoe Drive south side of the <br />identified stormwater basin and green space, to be constructed by the developer and maintained <br />in perpetuity by the homeowners association. <br />14. Addition of a bituminous trail connecting Fillmore and Edison Streets within the identified <br />access easement and generally north of the detached townhome lots, to be constructed by the <br />developer and maintained in perpetuity by the homeowners association. <br />15. Staff approval of updated drainage and utility plans and calculations based on the site plans <br />dated April 19, 2016. <br />16. Staff approval of all required plans based on the site plan dated April 19, 2016. <br />Approve, by motion, the Preliminary Plat request for Miske Meadows, with the following staff <br />recommended conditions: <br />1. Development Agreement shall be signed, outlining costs and responsibilities to the satisfaction <br />of the City Attorney. <br />2. All required wetland permits must be obtained prior to commencing work on the site. <br />Grading permits required as allowed upon City Engineer's approval of plan areas. <br />3. Parcels below 65 feet in width shall be platted on a parcel 5 feet from the front of the building <br />and 12 feet from the rear of the building. Side yards may abut. The remaining land between lots <br />and right-of-way shall be platted into a single parcel under common ownership of the <br />homeowners association. <br />Background/Discussion <br />During the May 2, 2016, Council meeting, staff was directed to prepare a list comparing staff s position, <br />Planning Commissions position, and the applicant's position. The list is attached, and the applicant has <br />had a chance to review the document and clarify their position as needed. <br />CUP/PUD Conditions <br />The discussion below provides additional information on staffs, the applicant's, and the Planning <br />Commission's position. All conditions for approval not described below are agreed to by staff, the <br />applicant, and the Planning Commission. <br />Condition Three - HOA Maintenance <br />Condition number three requires the Home Owners Association (HOA) to maintain turf and landscape <br />areas, remove snow from driveway and sidewalk areas, and maintain all exterior building coverings. The <br />applicant plans to include site maintenance in the HOA, but requests the removal of the requirement to <br />maintain exterior building coverings. They state the maintenance of exterior coverings is an unnecessary <br />expense for the HOA participants, noting that the detached units are no different than any other single <br />family home in quality and longevity of materials before maintenance is due and that upkeep will not be <br />needed for 15 to 20 years. The applicant indicated the anticipated increase to the HOA dues as a result of <br />requiring exterior maintenance would be up to $30 per month to each home and would derail the <br />affordability of the detached units. <br />Staff believes that by incorporating the maintenance of all exterior coverings (siding, roofing, and <br />windows) the long-term community aesthetics of the townhome areas will be preserved, and the HOA <br />will be in a better position to remain in existence. Attached townhome developments include the <br />maintenance of exterior coverings and staff recommends the same standard apply to the detached <br />townhome units included in Miske Meadows.
