See Section II.A,Covered For members of LMCIT, volunteers and volunteer organizations are covered <br /> parties. <br /> parties under the city's LMCIT liability coverage, as long as they are acting <br /> on behalf of the city and volunteering under the city's direction and control. <br /> LMCIT coverage responds to claims whether brought against the city, the <br /> volunteer, or both. <br /> It's important to keep in mind that not every volunteer who performs a <br /> community service is a city volunteer. Individuals often volunteer in <br /> connection with a project sponsored by a private organization or other <br /> governmental unit. One example is the Minnesota Department of <br /> Transportation's Adopt a Highway Program. These individuals perform a <br /> community service on their own, without city sponsorship or request. <br /> LMCIT coverage also includes the cost to defend a claim against a volunteer, <br /> even if the claim accuses the volunteer of an action that would constitute <br /> malfeasance,willful neglect of duty, or bad faith. LMCIT would not cover the <br /> damages awarded against the volunteer,however, if it is determined that the <br /> volunteer's action did constitute malfeasance,neglect of duty, or bad faith. <br /> IV.
