City Council Minutes <br />April 18, 2016 <br />Page 8 <br />Councilmember Westgaard questioned how this ordinance would work in the C3 <br />District where the city requires screening of rooftop mechanicals and could create <br />issues with setback requirements. <br />Ms. Mroz stated no setback requirements were changed and will still be required to <br />be met but an applicant could apply for a variance. <br />Councilmember Wagner concurred with Councilmember Westgaard's comments: <br />Ms. Mroz stated, as Energy City, this is something the city should want to promote <br />and not hide. She stated the ordinance, as currently written, doesn't address this <br />matter either way. <br />Attorney Beck, stated, as the ordinance is written, the screening requirements would <br />apply and this is currently the best way to handle the installations. He further stated <br />the city could look at the commercial setback requirements on a case-by-case basis <br />through the variance process. <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Olsen to adopt Ordinance 16-08 amending Section, 30-01, Definitions, and <br />Adding Section 30-805, Solar Energy Systems. Motion carried 5-0. <br />7.7 Die Concepts Microloan <br />Ms. Othoudt presented the staff report. <br />Mayor Dietz opened the public hearing for both the microloan application and the <br />jobs incentive microloan and blighted properties forgivable loan. There being no one <br />to speak to these issues, Mayor Dietz closed the public hearing. <br />Moved by Councilmember Wagner and seconded by Councilmember <br />Westgaard to adopt Resolution 16-23 approving loan agreement for Die <br />Concepts Project. Motion carried 5-0. (EDA) <br />Moved by Councilmember Burandt and seconded by Councilmember <br />Westgaard to adopt Resolution 16-24 approving loan agreement for Die <br />Concepts Project. Motion carried 5-0. (HRA) <br />8.1 Boys & Girls Club of Elk River Commercial Real Estate Loan Support <br />Request <br />Mr. Portner presented the staff report. He stated staff supports the resolution. <br />Mayor Dietz questioned the city's liability if there is a default in payments. <br />Mr. Portner stated there may be some exposure if there is a default on the initial loan <br />but not on this request. <br />p0VIInleet <br />A A-1-Vl!''RE <br />
