The Conditional Use Permit shall not be recorded until all applicable <br /> conditions have been completed. <br /> 2. The authorized use shall not begin until the Conditional Use Permit is <br /> recorded. <br /> 3. If the authorized use ceases for more than six months, the Conditional <br /> Use Permit shall expire. <br /> 4. The Conditional Use Permit is not a building permit and the applicant <br /> must apply for and receive approval of required building and sign permits <br /> before construction may begin. <br /> 5. The building shall meet all building and fire codes. <br /> 6. The private kennel shall be limited to five (5) animals over the age of 6 <br /> months. Additional animals will require an amendment to the <br /> Conditional Use Permit. <br /> 7. Animal waste, on or off site, shall be disposed of per City Ordinance <br /> Section 10-9. <br /> 8. The applicant shall receive a private kennel license from the city. <br /> 9. All animals must be licensed and vaccinated. <br /> 10. No dogs shall be allowed to run at large as outlined in Section 10-2. <br /> 11. No more than two (2) animals per supervisor shall be allowed outside of <br /> the fenced area. <br /> 12. All dog waste shall be cleaned up immediately when dogs are off of the <br /> subject property. <br /> 13. No dogs designated as dangerous or potentially dangerous are allowed to <br /> be kept at the kennel and keeping of a dangerous or potentially dangerous <br /> dog shall be grounds for revocation. <br /> Motion carried 5-0. <br /> 7.2 Rick Haugland, 21475 Highway 169 <br /> Rezone Property from CRT (Commercial Reserve Transition) to C3 <br /> (Highway Commercial) <br /> Conditional Use Permit for Auto Body Repair Facility <br /> Mr. Leeseberg presented the staff report. <br /> Mayor Dietz opened the public hearing for both the rezoning and the conditional <br /> use permit. There being no one to speak to these issues,Mayor Dietz closed the <br /> public hearing. <br /> Councilmember Westgaard questioned if the applicant is aware of the legal non- <br /> conforming use and how it can cease to exist and the 13 conditions outlined in the <br /> report. <br /> The applicant indicated yes. <br /> Moved by Councilmember Westgaard and seconded by Councilmember <br /> Olsen to adopt Ordinance 16-06 amending the City of Elk River Zoning Map <br /> p 0 W I R I D 0Y <br /> NREI <br /> ATU <br />
