Landscaping <br /> The building the operation will occur in is on the north end of the property with dense mature trees <br /> surrounding it on three sides. There is no screening to the building/parking from the property to the <br /> north,which is part of the ERX properties. The applicant is not proposing additional landscaping. <br /> Given the secluded nature and future use of the property to the north, staff does not see a need for <br /> further landscaping for screening purposes. <br /> Oak and Ash trees should avoid being cut April 1-August 1 to prevent the spread of diseases. If they <br /> must be removed during this time, they must be treated appropriately. <br /> Applicable Regulation <br /> CUP (delete this title) <br /> The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br /> 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other proper0 in the immediate <br /> viciniy or the public health, safe , morals, comfort, convenience or general welfare of the neighborhood or the city. <br /> It will not as the property is surrounded by Extreme Commercial Recreation, Commercial <br /> Reserve Transition, Medium Industrial, and Mineral Excavation Overlay. Most of the <br /> surrounding property is zoned for some form of commercial use. <br /> 2. Will be consistent with the comprehensive plan. <br /> With an approval of the rezoning (ZC 16-01), the proposal will be consistent with the <br /> comprehensive plan. <br /> 3. Will not impede the normal and orderly development and improvement of surrounding vacant propery. <br /> Given the scale of the existing use,it will not impede the normal and orderly development and <br /> improvement of surrounding vacant property. <br /> 4. Will be served adequately by and will not adversely affect essential public facilities and services including <br /> streets,police and fire protection, drainage, refuse disposal, water and sewer systems,parks and schools;and <br /> will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public <br /> thoroughfares. <br /> If compliance is verified for the septic systems,it will meet this requirement. <br /> 5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be <br /> detrimental to any persons or property because of excessive traffic, noise, smoke,fumes,glare, odors, dust or <br /> vibrations. <br /> All activities will take place within the building so there should be none of these detrimental <br /> concerns. <br /> 6.
