10. Land Use Amendments are reviewed by the Planning Commission and City Council <br />and are evaluated based on the following criteria: <br />a. What has changed to warrant the Land Use Change? <br />(1) How is the request consistent the City of Elk River Comprehensive <br />Plan? <br />(2) How compatible is it with surrounding properties? <br />(3) What are the benefits to the city? <br />11. Conditional Use Permits are reviewed in accordance with the following criteria, as <br />identified in section 30-654 of the Elk River City Code. <br />(1) Will not endanger, injure or detrimentally affect the use and <br />enjoyment of other property in the immediate vicinity or the public <br />health, safety, morals, comfort, convenience or general welfare of the <br />neighborhood or the city. <br />(2) Will be consistent with the comprehensive plan. <br />(3) Will not impede the normal and orderly development and <br />improvement of surrounding vacant property. <br />(4) Will be served adequately by and will not adversely affect essential <br />public facilities and services including streets, police and fire <br />protection, drainage, refuse disposal, water and sewer systems, parks <br />and schools; and will not, in particular, create traffic congestion or <br />interference with traffic on adjacent and neighboring public <br />thoroughfares. <br />(5) Will not involve uses, activities, processes, materials, equipment and <br />conditions of operation that will be detrimental to any persons or <br />property because of excessive traffic, noise, smoke, fumes, glare, <br />odors, dust or vibrations. <br />(6) Will not result in the destruction, loss or damage of a natural, scenic <br />or historic feature of major importance. <br />(7) Will fully comply with all other requirements of this Code, including <br />any applicable requirements and standards for the issuance of a <br />license or permit to establish and operate the proposed use in the city. <br />12. The Elk River City Code defines hotels in section 30-1 as follows: Hotel means any <br />building or portion thereof where lodging is offered to transient guests for <br />compensation and in which there are more than five sleeping rooms with no cooking <br />facilities in individual dwelling units. <br />13. The Planning Commission reviewed the Applications on January 26, 2016. <br />a. The Commission voted 5-0-1(Commissioner Johnson abstained) to deny the <br />Land Use Amendment application based on the following: <br />(1) The proposed use is not consistent with the comprehensive plan. <br />(2) The proposed use is not compatible with surrounding properties. <br />
