City of Elk *�� River RESOLUTION 16 - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION DENYING THE REQUEST FOR A LAND USE AMENDMENT AND A CONDITIONAL USE PERMIT TO CHANGE THE COMPREHENSIVE PLAN GUIDANCE AND ALLOW A HOTEL ON THE PROPERTY LOCATED AT 17432 ZANE STREET NW WHEREAS, Pat Briggs, Elk River Lodge and Residential Suites, ("Applicant"), has applied ("Application") for a Land Use Amendment (Case No. LS 16-01) to change the Comprehensive Plan guidance from FAST — The Point to Highway Business, and a Conditional Use Permit to operate a hotel (Case No. CU 16-01) for the property located at 17432 Zane Street NW; and WHEREAS, the record in this matter shall include all of the materials submitted to the Planning Commission and City Council in connection with the ■ December 29, 2015, Land Use Amendment application; and ■ December 29, 2015, Conditional Use Permit application; including the staff reports and all attachments thereto, all other written materials submitted to the Planning Commission and City Council, and all staff presentations and other testimony taken at the public meetings considering the Land Use Amendment and Conditional Use Permit, all of which is incorporated in and made a part of the findings of fact and this resolution; and WHEREAS, the Planning Commission held a public hearing on January 26, 2016, to receive testimony and evidence from city staff, the Applicant and any other persons regarding the Application; and WHEREAS, the Planning Commission recommended denial of the Application; and WHEREAS, the City Council held a public hearing on February 16, 2016, to receive testimony and evidence from city staff, the Applicant and any other persons regarding whether the Application should be approved; and WHEREAS, the Applicant and all others wishing to speak were given numerous opportunities to present testimony to the Planning Commission and City Council; and NAWRE....
