SCHEDULE E <br /> Certificate of Completion and Release of Forfeiture <br /> The Economic Development Authority in and for the City of Elk River (the <br /> Authority), a Minnesota public body corporate and politic, by a warranty deed (the <br /> Deed) recorded in the Office of the County Recorder of Sherburne County, <br /> Minnesota, as Document Number , has conveyed to Bryan L. Jones <br /> (the Developer) the following described land: <br /> Lot 2, Block 1, Elk River Industrial Park, according to the plat therof on file <br /> and of record in the office of the County Recorder in and for Sherburne <br /> County, Minnesota. <br /> The Deed incorporated certain covenants and restrictions in that certain <br /> Contract for Private Development between the Authority and Developer recorded in <br /> the Office of the County Recorder of Sherburne County, Minnesota, as Document <br /> Number (the Development Contract), the breach of which by Developer, <br /> is successors and assigns, could result in a forfeiture and right of re-entry by the <br /> Authority, its successors and assigns, pursuant to the terms of the Deed. <br /> . The Developer has to the present date performed said covenants and <br /> conditions insofar as it is able in a manner deemed sufficient by the Authority to <br /> permit the execution and recording of this certification. <br /> NOW, THEREFORE, this is to certify that all building construction and <br /> other physical improvements specified to be done and made by Developer have been <br /> duly and fully performed by Developer therein and that the provisions for forfeiture <br /> of title and right to re-entry for breach of condition subsequent by the Authority <br /> therein are hereby released absolutely and forever insofar as it applies to the land <br /> described herein, and the County Recorder in and for the County of Sherburne and <br /> State of Minnesota is hereby authorized to accept for recording and to record the <br /> filing of this instrument, to be a conclusive termination of the right of re-entry and <br /> forfeiture of title in favor of the Authority as set forth in the Deed and the <br /> Development Contract, but the remaining provisions and covenants of the Deed and <br /> the Development Contract shall remain in full force and effect. <br /> Dated: THE ECONOMIC DEVELOPMENT <br /> AUTHORITY IN AND FOR THE <br /> CITY OF ELK RIVER <br /> By: <br /> Its: <br /> • <br /> E-1 <br /> BeckP 548540.1 <br />
