facilities (determined on the basis of square footage) are used for a <br /> . purpose other than: <br /> (1) The manufacturing or production of tangible personal property, <br /> including processing resulting in the change in condition of the <br /> property; <br /> (2) warehousing, storage, and distribution of tangible personal property, <br /> excluding retail sales; <br /> (3) research and development related to the activities listed in clause (1) or <br /> (2); <br /> (4) telemarketing if that activity is the exclusive use of the property; <br /> (5) tourism facilities;or <br /> (6) space necessary for and related to the activities listed in clause (1) to <br /> (5). <br /> ARTICLE IV. <br /> Construction of Minimum Improvements <br /> Section IV.1 Construction and Operation of Minimum Improvements. <br /> • (a) The Developer agrees that it will construct the Minimum <br /> Improvements on the Development Property in accordance with the approved <br /> Construction Plans, together with any changes approved by the Authority and any <br /> changes not requiring the Authority's approval, on or before the Completion Date, <br /> and at all times prior to the date on which the Authority has received Tax <br /> Increment sufficient to fully reimburse it for the Market Value of the Development <br /> Property, will operate and maintain, preserve and keep the Minimum <br /> Improvements or cause the Minimum Improvements to be maintained, preserved <br /> and kept with the appurtenances and every part and parcel thereof, in good repair <br /> and condition. <br /> (b) At the time of execution of this Agreement, the Developer and the <br /> Authority have entered into a Job Performance Agreement, as required pursuant to <br /> Minnesota Statutes, section 116J.991, the terms of which are incorporated herein <br /> and made a part hereof by reference. <br /> Section IV.2 Construction Plans. <br /> (a) The Developer has obtained approval relative to the development of <br /> the Minimum Improvements. Within ninety (90) days from the date hereof, the <br /> Developer shall submit to the Authority Construction Plans for the Minimum <br /> • Improvements.
