Memo to EDA <br /> Snowmobile Trail Permit <br /> November 13,2000 <br /> Page 2 <br /> • <br /> The City may consider locating the proposed southerly trail within the <br /> 173rd Avenue rights-of-way, rather than along the EDA property line. <br /> Trail Permits <br /> Attached is a Sherburne County Snowmobile Trail Permit as drafted by <br /> the Snow Riders Club. The permit may be terminated upon sale of the <br /> property, or upon a six-month written notification. A 12-foot trail width <br /> is being proposed. <br /> Liability Issues <br /> The State of Minnesota has a statute to protect landowners from liability <br /> lawsuits when permission has been granted without charge. Attached is <br /> a copy of MN Statute 604A.23 and summary provided by the River City <br /> Snow Riders Club. <br /> Action Requested <br /> Should the EDA choose to grant the request, staff recommends that the <br /> following conditions be added to the permit: <br /> 1. Permit will be considered for issuance on an annual basis <br /> 2. Trail use is limited to within an area 300' from the west <br /> property line <br /> i <br />
