<br />J3-e~ b:~.-0.lo. <br />\~C1I'~~~ <br /> <br />RESOLUTION NO. 04 - <br /> <br />CITY OF ELK RIVER <br />A RESOLUTION DENYING THE PROPOSED ZONE CHANGE FROM R1d <br />TO PUD FOR: <br /> <br />RIVER PARK <br /> <br />Case No. ZC 04-06 <br /> <br />WHEREAS, application has been made for a rezoning from RId to Planned Unit <br /> <br /> <br />Development for "River Park", pursuant to the Elk River City Code of Ordinances; and <br /> <br /> <br />WHEREAS, the application for rezoning has been referred to the Planning <br /> <br /> <br />Commission which has given its advice and recommendation to the City Council; and <br /> <br /> <br />WHEREAS, the on August 10, 2004 the Planning Commission recommendation <br /> <br /> <br />was to deny the request for rezoning; and <br /> <br /> <br />WHEREAS, on September 20, 2004 the City Council received public comment and <br /> <br /> <br />considered the Planning Commission recommendation of denial; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF ELK RIVER, that the proposed rezoning from RId to PUD for "River Park" is <br />denied based on the following findings: <br /> <br />1. The current zoning is consistent with the Comprehensive plan land use designation <br />ofMR (Medium Density Residential). <br />2. There is no compelling reason for the rezoning request. <br />3. The proposed rezoning to PUD is not compatible with the adjacent RIa (Single <br />family Residential) zoning district. <br />4. The proposed rezoning to PUD allows for increased higher residential density <br />which would result in higher generation of traffic than the existing zoning. <br />5. The proposal is premature due to lack of adequate in-place infrastructure (water, <br />sewer, transportation). <br />6. The project would be detrimental to public safety. <br />
