<br />Memo to City Council/P 04--17 <br />Sept{:mber 20, 2004 <br />Page 2 <br /> <br />--------------- <br /> <br />Overview <br /> <br />The applicant is proposing a 32 lot single family development on a 14-acre parcel that will be <br />accessed from County Road 12 on the north and from the Elk Meadows/Kliever Lake <br />Fields subdivisions from the east at 180th Avenue. The Final Plat is consistent with the <br />Preliminary Plat that was approved. <br /> <br />The Park and Recreation Commission recommended that cash for 32 lots be paid for park <br />dedication. <br /> <br />Access and Circulation <br /> <br />There was discussion at the August 16, 2004 City Council meeting regarding which street, if <br />not both, should be platted to the southern property line of the proposed plat. Council gave <br />staff direction to explore extending Nixon Circle to the south property line. The main <br />concern with this location is the existence of a major power line pole in the location needed <br />for the road right-of-way. <br /> <br />Staff visited the site and examined the existing conditions and recommends that Nixon <br />Circle not be the connector street. Due to the physical size of the power pole, which has <br />two support legs and carries three lines, staff has concern that this would place undue <br />physical and economical hardship on the property owner to the south when they proceed <br />with platting their property. The power line is in its own easement, therefore there would be <br />costs associated with having the poles moved. Staff recommends that the proposed plan, <br />with Olson Circle platted to the south property line, be approved. <br /> <br />Gradinr. Drainall"e and Utilities <br /> <br />Grading, drainage and utilities have been addressed in the City Engineer's memos. <br /> <br />Recommendation <br /> <br />Staff recommends that the City Council approve the Final Plat of Belmont Estates with the <br />following conditions: <br /> <br />1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. <br />2. ALLCOMMENTSOFSHERBURNECOUNTYSHALLBE <br />ADDRESSED. <br />3. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE <br />PLAT FOR RECORDING. <br />4. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF <br />THE IMPROVEMENTS SHALL BE SUBMITTED PRIOR TO <br />RELEASING THE PLAT FOR RECORDING. <br />5. THE APPLICANT SHALL EXECUTE A DEVELOPER'S AGREEMENT <br />OUTLINING THE TERMS AND CONDITIONS OF APPROVAL. <br />6.
