<br /> <br />Item #5.1.. <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Mayor and City Council <br />Scott Harlicker, Senior Plann~ <br />October 1B, 2004 <br /> <br />TO: <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Case No. EV 04-04 <br />Request by Phoenix Enterprises for Vacation of Drainage and <br />Utility Easements <br /> <br />Reauest <br /> <br />The applicant requests that the City Council approve the vacation of a portion of a drainage <br />and utility easement located on Lot 2, Block 2, Hillside Crossing. This request is related to <br />the conditional use permit for the construction of an office building. <br /> <br />Attachments <br /> <br />. Location Map <br />. Resolution No. 04-_, Approving the Easement Vacations <br />. Exhibits showing existing easement and proposed easement. <br /> <br />Analysis <br /> <br />The applicant is requesting an easement vacation because the stormsewer pipe that is located <br />within the easement is being relocated. The existing easement can be reduced in size to <br />reflect the new placement if the stormsewer. The vacation will also allow the applicant to <br />place the building as proposed in the current site plan. <br /> <br />The City Engineer is reviewing this request and will be available to answer questions. <br /> <br />Recommendation <br /> <br />Staff recommends that the City Council approve the attached resolution, vacating the <br />drainage and utility easements as requested with the following conditions: <br />
