SERVICES AGREEMENT <br /> THIS SERVICES AGREEMENT("Agreement")is made on 3e.n I i ,2016 by and <br /> between Tri-County Action Program,(hereinafter known as"CAP"), a`IiAinnesota nonprofit <br /> Corporation, (1210 23t Avenue S.,P.O. Box 683,Waite Park,MN 56387-0683, and Elk River <br /> Municipal Utilities(hereinafter known as"ERMU"), 13069 Orono Parkway, P.O. Box 430, Elk <br /> River,MN 55330-0430. <br /> WHEREAS,ERMU's Conservation Improvement Program(hereinafter known as"CIP")has <br /> funding available to provide energy efficiency,health and safety related services to customers of <br /> ERMU that are eligible based on the qualifying criteria of the Weatherization Assistance and the <br /> Energy Assistance Programs administered by the Minnesota Department of Commerce(each a <br /> "Program"). <br /> WHEREAS, CAP is an experienced provider of services under the Programs and is willing to <br /> provide to ERMU one or more of the services described in Exhibit A("Services"), subject to the <br /> terms and conditions of this Agreement, <br /> NOW THEREFORE,the parties agree as follows: <br /> 1. Performance of Services <br /> CAP shall perform Services upon receipt of approval by ERMU identifying the Services <br /> to be performed and the funding associated with the approved Services. CAP understands <br /> that CIP funds can be accessed by more than one provider and,due to funding <br /> limitations, CIP funds are made available on a first-come,first-serve basis.
