NOTICE OF HEARING <br />TO: HiTech Motor Sports, 16820 US Highway 10, Elk River, MN 55330 <br />First National Bank of Le Center, Property Owner, 10 W Minnesota St, PO Box <br />160, Le Center, MN 56057 <br />Barton C. Wells, Operator, 4000 Stratford Ridge, Excelsior, MN 55331 <br />NOTICE IS HEREBY GIVEN that the City Council of the City of Elk River has <br />directed that a hearing be scheduled before the City Council to receive testimony and <br />evidence, to establish findings, and to determine whether the Conditional Use Permit for <br />HiTech Motorsports shall be revoked for failure to comply with the conditions set forth in <br />the approval of the Conditional Use Permit. <br />The hearing has been scheduled for 6:00 p.m. on Monday, June 15, 2015, at Elk <br />River City Hall. <br />The hearing will address whether HiTech Motorsports is in compliance with the <br />conditions set forth in the approval of the Conditional Use Permit for the custom tuning <br />facility. Specific areas of potential noncompliance include: <br />■ whether the overnight outside storage of vehicles has occurred; and <br />■ whether the repair or maintenance of vehicles outside of the building has <br />occurred; and <br />■ whether the level of noise from the building exceeded city ordinance levels; <br />and <br />■ whether the doors of the facility have been kept open while operating, tuning, <br />and testing vehicles. <br />At the hearing on June 15, 2015, the City Council will receive testimony and <br />evidence from the public and city staff regarding the compliance or non-compliance of <br />HiTech Motorsports with the conditions set forth in the approval of the Conditional Use <br />Permit for the custom tuning facility. The property owner and the owner or operator of <br />HiTech Motorsports, as well as all members of the public, shall have an opportunity to <br />testify and present evidence. At the conclusion of the public hearing, the City Council <br />may continue its decision to a future date or make its findings and determination. <br />
