Dargis <br />James Burgoyne <br />Vacation of York Street, formerly known as Oak Street between Blocks 2 and 3, Map of <br />Orono (Sherburne County, Minnesota) <br />The enclosed 2015 Land Use Application Form dated October 29, 2015 is to request the vacation <br />of York Street, formerly known as Oak Street, between Blocks 2 and 3, Map of Orono (Sherburne <br />County, Minnesota). <br />The purpose of the easement vacation is to eliminate the City of Elk River's easement for roadway <br />purposes over the above property. <br />The Elk River City Council denied the vacation of this property on January 17, 2006. The vacation <br />was denied based upon a statement by Scott Harlicker, the Elk River Senior Planner, that the right <br />of ways on Xenia and Watson Streets had not been vacated. This was not accurate. The motion <br />to deny the vacation by Councilmember Farber stated "that in order to be consistent and not set a <br />precedent the City should deny granting the ROW to the applicant". <br />The actual fact is that all of the streets adjacent to the lake had been vacated (Vine Street, Xenia <br />Avenue and Pine Street), except York Street. <br />The Elk River City Council, on August 18, 1975, closed York Avenue as a boat landing. The Elk <br />River City Council on June 7, 1976 also passed a motion to prohibit boat launching on York Street <br />at Lake Orono. <br />York Street is used and built as a driveway for the home at 1946 Main Street, Elk River, MN. <br />York Street between Blocks 2 and 3, Orono, is useless for the purpose for it was originally laid <br />out. There is no public purpose to keep this portion of York Street as a public street when all the <br />other three streets in Orono adjacent to the lake already have been vacated. <br />
