IMIBO <br />STATE OF MINNESOTA <br />/--:a <br />VILLAGE OF ELK RIVER <br />RffimmoN By VILLAGE.COUNCIL VAGATIM STREET <br />In the flatter of the Tacati.oa of that part of Walnut Street <br />between the Noortherly 1Iineatween of Main Streetanand4lakee in Orono. <br />The above entitled matter came on to be heard before the Village <br />Council of the Village of Elk River, Sherburne County, Minnesota,. <br />upon the petition of Howard Wirtz and Viola Wirtz, his'wife and. <br />James D. Thomas and Loretta Thomas, his wife, for the vacation of <br />a portion of walnut Sheet in Orono therein described; and the Vil- <br />lage Council having given due notice of said hearingby published <br />and poded notice as provided by law and said hearing having been <br />held on the 21st dap of VA 1973, at s:oo o1clock P.M. <br />at the Counci7saza and no one appeared in <br />opposition thereto, andthe said Council after hearing the evidence <br />presented to it in favor of said petition finds; That petitioners <br />are the owners of all the land abutting said portion of Walnut <br />Street sought to be vacated; that said portion of Walnut Street is <br />not serving �}+ public purpose, and that it would be in the best <br />Interests of the public to vacate said portion of Walnut Street; <br />Councilman C]Itford Lauaorg introduced the following <br />resolution, to- t: <br />That portion of Walnut Street (now Xenia Avemie)lyiug between <br />Blocks 3 and 4, in Orono, between the Northerly line of Main <br />Street and Lake Orono, be and the same hereby is vacated, n <br />Which resolution was seconded by Councilman Toa Hudson <br />being put to a vote a majority of said Counc vote i.n avor <br />said resolution, whereupon said resolution was declared adopted <br />the Mayor of said Village. <br />Dated at the Village of Elk River, <br />Minnesota, this 21st day of May 1973, <br />:t reserving to said Village an easement for <br />_ r. purpass of maintandng aster line from the <br />existing hydrant on Rein Street to Lake Or <br />ark <br />STATE OF MINNESOTA ) <br />ss. <br />COUNTY OF SNERBURNE <br />Charles Savela, being first duly sworn says that he is the duly <br />elected, qualified and acting Village Clerk of the Village of Elk <br />River, Sherburne County, Minnesota, and as such is custodian of the <br />records of said Village; that'the above resolution is a true and <br />correct copy of said resolution taken from the records of the min- <br />utes of the Village Cotmp!.l...oE_said y 1age f the reQiilar meetiu <br />thereof held on may ziA //: -1�7 <br />197Subs7 <br />ibed and <br />sworn to before me <br />
