Recommendation
There remains a question regarding the public benefit for vacating the subject right-of-way. Regardless of
historic, existing, or potential future uses, the laws pertaining to vacation of public rights-of-way stipulate
the need for a demonstrated public interest. Staff has not identified a public interest or benefit in vacating
a right-of-way with lake access and recommends denial of the request. If there is a desire to formalize
ingress/egress for the home located at 1946 Main Street a license agreement providing them the right
could be drafted.
Financial Impact
None
Attachments
■ Location Map
■ Applicants Narrative dated October 29, 2015
■ Keith Parker, DNR Central Region Director, letter dated December 14, 2015
■ Property Survey dated September 24, 1974
■ James Neilson correspondence dated October 28, 2015 and attachments
■ James Neilson correspondence dated October 29, 2015 and attachments
■ James Neilson correspondence dated October 30, 2015 and attachments
■ Information submitted by Jim Neilson December 29, 2015
■ Information submitted by Ron and Paula Dargis December 29, 2015
o Letter from vacation applicants
o City Council Minutes regarding York Ave
o Additional information regarding January 17, 2006 vacation hearing
o Signed petitions supporting vacation of York Ave right-of-way
o Star News articles pertaining to York Ave right-of-way
o Photos of Lake Orono boat launch
N:\Public Bodies\Agenda Packets\01-04-2016\Fina1\x7.1 sr Dargis EV.docx
