r. <br />STATE OF MINNESOTA <br />COUNTY OF SHERBURNE <br />138780 <br />VILLAGE OF ELK RIVER <br />RESOLUTION BY VILLAGE COUNCIL VACATING STREET <br />In the Matter of the Vacation of that part of Walnut Street <br />(new -Xenia Avenue) lying between locks 3 and 4, in Orono, <br />between the Northerly lane of Main Street and Lake Orono. <br />The above entitled matter came on to be heard before the Village <br />Council of the Village of Elk River, Sherburne County, Minnesota,, <br />upon the petition of Howard Wirtz and Viola Wirtz, his wife, and. <br />James D. Thomas and Loretta Thomas, his wife, for the vacation of <br />a portion of Walnut Street in Orono therein described; and the Vil- <br />lage Council having given due notice of said hearing by published <br />and podmd notice as provided by law and said hearing having been <br />jheld on the list day of� May , 1973, at g;oo o'clock P.M. <br />!at the Counc�hambers zn said viilage, and no one appeared in <br />opposition thereto, and the said Council after hearing the evidence <br />presented to it in favor of said petition finds: That petitioners <br />are the owners of all the land abutting said portion of Walnut <br />Street sought to be vacated; that said portion of Walnut Street is <br />not serving any public purpose, and that it would be in the best <br />interests of the public to vacate said portion of Walnut Street; <br />Councilman Clifford Lundberg introduced the following <br />resolution, to -w t: <br />That portion of Walnut Street (now Xenia Avenue)lying between <br />Blocks 3 and 4, in Orono, between the Northerly line of Main <br />Street and Lake Orono, be and the same hereby is vacated. * <br />Which resolution was seconded by Councilman Tom Hudson <br />and being put to a vote a majority of said Councz vote 1n favor <br />of said resolution, whereupon said resolution was declared adopted <br />by the Mayor of said Village. <br />Dated at the Village of Elk River, <br />Minnesota, this 21st day of May 1973. <br />reserving to said Village an easement for <br />1 > purpose of maintaining water line from the <br />existing hydrant on hIain Street to Lake Or <br />lerk <br />STATE OF -MINNESOTA <br />ss. <br />COUNTY OF SHERBURNE <br />Charles Savela, being first duly sworn says that he is the duly <br />elected, qualified and acting Village Clerk of the Village of Elk <br />River, Sherburne County, Minnesota, and as such is custodian of the <br />records of said Village; that•the above resolution is a true and <br />correct copy of said resolution taken from the records of the min- <br />utes of the Village Coun of....s.aidla e, f. the re lar meeting <br />thereof held on May 21A �;�.0 197,3: <br />Save <br />subscribed and sworn to before me 1t 's r— day�of__� <br />1973. <br />� - T' <br />
