Port Authorities <br /> Minn.Stat.§469.065,subd. A Port Authority may sell or convey property it owns within a port or <br /> t. <br /> industrial district,but must hold a public hearing on the proposed sale. A taxpayer <br /> may appeal the decision in district court by serving legal notice on the <br /> secretary of the Port Authority. Such service must occur within 20 days after <br /> the Port Authority enters its decision on its records. The only basis for <br /> appeal,however, is that the action of the Port Authority was arbitrary, <br /> capricious, or contrary to law. <br /> Minn.Stat.§469.065,subds. The terms and conditions of the sale of the property must include its <br /> 4 and 5. <br /> intended and allowable use. A Port Authority may require the buyer to file a <br /> security to ensure the property will be given that use. <br /> Minn.Stat.§469.065,subd. The purchaser must devote the property to its intended use or begin work on <br /> 5 and 6. <br /> improvements to the property to devote it to that use. If the purchaser fails to <br /> do this, a Port Authority may cancel the sale and the title of the property will <br /> return to the Port Authority. It may extend the period of time to comply with <br /> a condition if the buyer has good cause. <br /> Minn.Stat.§469.065,subd.
