City of ElIk Memorandum T- ,1 r To: Mayor and City Council From: Bob Pearson, Secretary (ret.),Elk River Fire Department Relief Association Date: November 16, 2015 Subject: Bylaw Changes Summary Below is a summary of the proposed changes to the Elk River Fire Department Relief Association ("Association") bylaws: ■ The Association is adopting a Records Retention Schedule that is filed with the Minnesota Historical Society. Without an approved Records Retention Schedule, the Association is required to retain all records indefinitely. ■ Membership in the Association is automatic and concurrent with membership in the Fire Department. ■ Strengthened the sections on Leave of Absence and Military Leave. ■ Provides the option for the Association to create an Aid Committee. ■ Allows for meeting notices to be sent electronically. ■ The new bylaws are intended to dove-tail with new set of policies for the operation of the relief. An example of this would be Section 5.3, "Disbursements". The by- law state that disbursement of funds won't be issued until approved by the Board of Trustees. ■ Per the state auditor's office, changes were made to the payment of interest on a deferred service pension. Interest is paid based on the following criteria: ■ Anyone retiring with less than twenty years of service: No change you will not gain any interest. ■ Anyone retiring under 50 with twenty or more years of service: gain 3% interest for up to five years. ■ Anyone over 50 with twenty or more years of service: gain 3% interest for up to five years. ■ Our current bylaws state that if a firefighter over 50 retires and leaves their funds with the Association, they will collect no interest.
