BY-LAWS OF THE <br /> ELK RIVER FIREMAN' RELIEF ASSOCIATION <br /> PREAMBLE <br /> The Elle River Fire Department Relief Association is a defined benefit plan and is subject to sections <br /> 69.771 through 69.774 and 424A.015, and 424A.02 of Minnesota State statutes. <br /> ARTICLE 1 <br /> MEMBERSHIP <br /> SECTION 1. Any regular member of the Elk River Fire Department shall be eligible for membership <br /> in this association. <br /> SECTION 2. Resignation from the Elk River Fire Department or moving from (the vicinity of) Elk <br /> River to take up residence elsewhere, shall terminate the membership of the member so resigning, <br /> expelled or removing;provided, however, that any member who has served for at least the minimum <br /> number of years required by Article VIII of these bylaws for vesting of pension rights as an active <br /> member of the Elk River Fire Department shall retain membership in this association, regardless of <br /> resignation, expulsion or removal, subject to regulations which may be from time to time imposed. <br /> SECTION 3. Any member who shall, in the opinion of a majority of the board of trustees, fraudulently <br /> claim benefits from, or defraud or attempt to defraud the association in any way, shall be suspended <br /> from membership by the board, and shall forfeit all further rights to benefits from the association. <br /> SECTION 4. Any suspended member can only be reinstated upon his application, therefore, in <br /> writing, presented at a regular or special meeting of the association. Reinstatement requires a favorable <br /> vote of 2/3 for the members present and voting at such a meeting. <br /> SECTION 5. Active Service: The active performance of fire suppression duties or the supervision of <br /> fire suppression duties. The performance of suppression or supervision of fire suppression duties <br /> includes meeting the requirements spelled out in the Elk River Fire Department Standard Operating <br /> Guidelines as approved by the fire chief. Annually, three weeks prior to the Department Annual <br /> Meeting, the fire chief shall submit a certified roster to the Board of Trustees certifying each member's <br /> active service credit for the prior year. <br /> SECTION 6. Regular Work Hours: Scheduled hours for fulltime employees of the City of Elk River. <br /> Regular work hours are typically Monday thru Friday, 8:00 AM to 4:30 PM but may vary by position. <br /> Regular work hours are typically 40 hours per week and include any scheduled, mandatory overtime. <br />
