City Council Minutes Page 5 <br />September 21, 2015 <br />----------------------------- <br />Moved by Councilmember Wagner and seconded by Councilmember Olsen <br />to adopt Ordinance 15-30 amending Section 30,991 (b), R-1 districts of the <br />City of Elk River, Minnesota City Code. Motion carried 5-0. <br /> <br />7.2 Ordinance Amendment for Pool Fences <br /> <br />Mr. Leeseberg presented the staff report. <br /> <br />Mayor Dietz opened the public hearing. There being no one to speak to this issue, <br />Mayor Dietz closed the public hearing. <br /> <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Olsen to adopt Ordinance 15-31 Amending Sections, 30-796, Fences; 30-1007, <br />Accessory Structures; 30-1042, Accessory structure setbacks; 30-1582, <br />Accessory structure setbacks of the City of Elk River, Minnesota, City Code. <br />Motion carried 5-0. <br /> <br />7.3 Plant Place, Inc. Conditional Use Permit <br /> <br />Mr. Leeseberg presented Mr. Carlton’s staff report. <br /> <br />Mayor Dietz opened the public hearing. There being no one to speak to this issue, <br />Mayor Dietz closed the public hearing. <br /> <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Olsen to approve Conditional Use Permit, Case No. CU 15-12 with the <br />following conditions: <br /> <br /> <br />1.As a Conditional Use Permit is not a Building Permit, the applicant shall <br />apply for all required permits. <br /> <br />2.The proposed storage area shall be reduced in size so as not exceed one- <br />half acre in total storage area. <br /> <br />3.Any proposed expansion of the impervious surface area shall be submitted <br />to the city to review for compliance with city stormwater requirements. <br /> <br />4.Monday through Friday business operations shall not occur outside of the <br />hours of 8 a.m. to 5 p.m. <br /> <br />5.From April through June, business operations may occur 9 a.m. to noon <br />on Saturdays. <br /> <br />6.Retail sales are not permitted. <br /> <br />7.Wholesale to the general public is not permitted. <br /> <br />8.Noise levels shall not exceed the MPCA noise pollution guidelines for <br />residential uses at the property line. <br /> <br />9.Freestanding signage shall be limited to six feet in area and six feet in <br />height. <br /> <br />10.The Conditional Use Permit shall not be recorded until all applicable <br />conditions are substantially completed. <br /> <br />
