Ordinance IS - -,:UL <br />Strikethilattghs to be removed <br />Underlines to be added <br />An Ordinance Amending Section, 30-99 I (h), R- I districts of the City of Elk River, <br />Minnesota, City Code <br />The City Council of the City of Elk River does hereby ordain as follows: <br />SECTION 1. That § 30-991 (b), R-1 districts of the City of Elk River Code of Ordinances shall be <br />amended to read as follows: <br />(b) Permitted uses. Permitted uses in the R-1 districts are as follows: <br />14 Accessojy Dwelling Units on single fiapI4 detached lotsprovided: <br />a. Not more than one (1) accessory dwelling unit shall be allowed on a single-family <br />detached lot. <br />b. An accessory dwelling unit may be Permitted within a principal single family dwelling <br />unit or in a detached accessojy structure. <br />c. An accesso T dwelling unit shall require a building permit that may only be a1212hed for <br />concurrently with the application for a building_ Permit for construction of the principal <br />single family dwelling unit on the lot or after the construction of the principal structure. <br />d. A detached accessory dwelling unit shall be counted towards the total number of allowed <br />accessory structures on a parcel. <br />e. A rental license for the accesso dwelling unit is obtained pursuant to Chapter 30 <br />Article III Division 3 of the Ci Code. <br />f. An accessory= dwelling unit shall be clearly a subordinate part of the principal single <br />family dwelling unit on the lot and the living area shall not be more than 1.000 square <br />feet, not less than 250 square feet in size. <br />g. No more than two Q sleeping rooms shall be. allowed in an accessory dwelling unit <br />h. The entrance to an accessory dwelling unit shall not be in the front yard of the principal <br />single family dwelling unit. <br />i. In the A-1 and R -1a districts and on lots aeater than 2/z acres in the R -1b R -1c R -1d <br />Rte and residential PUD districts detached accessory dwelling units may be finished <br />with wood vinyl lap siding,metal sidin metal panels, and/or maso . On lots less <br />than T/z acres in the R-1b,R-1 c R-1 d R--1 e and residential PUD districts detached <br />accessoty dwelling units may be finished with wood vinyl lap siding,metal siding, <br />ander masonry. <br />j. <br />Accessory dwelling units in combination with their associated 12tindPal single famil <br />dwelling unit must conform to all city code requirements for single family dwellings_ <br />including but not limited to setback, height, impervious surface, and accessory structure <br />standards. <br />Last Updated March 2014 <br />NATUR <br />
