A material supplier is <br /> defined as a person or business that supplies materials, equipment, or supplies to a contractor or <br /> subcontractor on a project,but does not include a person or business that delivers and deposits <br /> into place mineral aggregate that is incorporated into the work under the contract. <br /> Current statute states that a responsible contractor is needed for publicly owned or financed <br /> projects with estimated contracts over$50,000. The new law clarifies that tax increment <br /> financing must be excluded in determining whether the construction contract exceeds $50,000. <br /> The minimum requirements for a responsible contractor are clarified. The contractor must be in <br /> compliance with the Department of Revenue and the Department of Employment and Economic <br /> Development registration requirements if it has employees. A responsible contractor must not be <br /> debarred by a political subdivision that has the authority to debar a contractor. All <br /> subcontractors and motor carriers must sign a notarized statement that they meet criteria. <br /> Non-compliance of contractors for non-payment is clarified. A contractor can be found non- <br /> complaint for repeatedly failing to pay statutorily-required wages or penalties for separate <br /> projects over$25,000 only if it involves two or more separate and distinct occurrences of <br /> underpayment during the three-year period. <br /> A prime contractor, subcontractor, or motor carrier that fails to verify compliance with any of the <br /> required criteria or makes a false statement under oath shall be ineligible for the contract. Prior <br /> to the execution of the contract,the prime contractor must get signed verification of compliance <br /> from all first-tier subcontractors. A prime contractor shall annually obtain signed verification of <br /> all motor carriers with which it will have a contractual relationship. A motor carrier must <br /> immediately notify the prime contractor if it no longer meets criteria, and it becomes ineligible to <br /> work on a project. <br /> A contracting authority may still establish additional factors for defining contractor <br /> responsibility. <br /> Effective date: July 1, 2015 <br /> Project solicitations must note that any prime contractor, subcontractor, or motor carrier that <br /> does not meet the minimum criteria of a responsible contractor is not eligible for contract award. <br /> (This provision is effective for solicitation documents issued on or after January 1, 2015.) <br /> TRANSPORTATION BUDGET OMNIBUS BILL <br /> 2015 Session Laws Chapter 75 <br /> *SF 1647 Rep.
